GENERAL CONDITIONS OF SALE
PREAMBLE
These general conditions of sale apply between “Paul Ward”

And “the Customer”: any natural person who acts in an individual capacity or as a representative of a legal entity visiting or making, via the website www.paul-ward.com owned by Paul Ward, a purchase of products via the website www.paul-ward.com
OBJECT
These general terms and conditions of sale cancel and replace all previous conditions or documents and apply to all product orders placed on the site. The GTC prevail over any other document.
All relations between Paul Ward and the Client are governed by these General Terms and Conditions.
The purpose of these general conditions is to define the rights and obligations of the parties in the context of the distance sale of products offered on the site www.paul-ward.com from order placement to payment and delivery, to after-sales service and warranties.
When confirming any order on the website www.paul-ward.com , the customer certifies that they have read and accepted these General Terms and Conditions and accept them expressly and without reservation, without this acceptance being conditional on their signature.
The T&Cs may be subject to updates or modifications without notice.
The General Terms and Conditions applicable and binding on the Customer are those in force at the time the order is placed and the price is paid.
Sales on the Site are reserved for Customers, natural persons aged over 18.
The Customer has the option to save and print these General Terms and Conditions.
PRODUCTS
The products offered for sale by Paul Ward, prescription glasses and sunglasses with or without prescription, are those listed on the website www.paul-ward.com on the day the Customer consults the website.
Products are offered while stocks last. However, if a stock error occurs, Paul Ward undertakes to inform the Customer as soon as possible and schedule a new delivery date based on its restocking. In the absence of agreement or if the ordered product is not available, Paul Ward will refund the sums paid by the Customer within a maximum period of 10 days, without the latter being able to claim any compensation.
The Customer is solely responsible for their choice of products, their suitability for their needs, and their use in accordance with the manufacturer's instructions. Paul Ward cannot be held liable in this regard.
PRICE
Product prices are indicated on the online sales area dedicated to this purpose.
Prices are listed in euros, inclusive of all applicable taxes in Metropolitan France. They include the current Value Added Tax (VAT). Any change in the applicable VAT rate will be automatically reflected in the price of products sold on the site.
These prices do not include shipping costs which will be indicated in addition to the price during the ordering stage and before the Customer confirms their order.
ORDER
- step 1: The Customer chooses the products and places them in the basket
- step 2: The Customer creates their account and enters their delivery information
- step 3: The Customer enters their payment details and is informed of the payment terms
- step 4: The Customer is invited to validate the Payment of his order online after having read and accepted these General Terms and Conditions
- step 5: The Customer receives a confirmation email and a summary of their order to keep. This confirmation will include the following contractual information: The address to which the customer has chosen to have the ordered products delivered and payment terms
The order only becomes final after:
- payment of the full price by the Customer;
- verification of the availability of the product by Paul Ward as soon as possible after sending the email acknowledging receipt of said order to the Customer.
PAYMENT
Payment is made online by credit card (also possible via Paypal). In all cases, online payment by credit card is secure. The transmission of payment data is encrypted from the moment it is entered.
DELIVERY
FRANCE
Paul Ward offers free delivery anywhere in mainland France. Our standard delivery service allows you to receive your order at your home, a business address, or a local collection point.
Your order will arrive within 5 business days* (excluding weekends and public holidays). Deliveries take place Monday to Friday, between 8 a.m. and 7 p.m. You will receive an email as soon as your order has been shipped from our warehouse, so you will be able to track the progress of your package.
INTERNATIONAL
If you live outside of France, we will use FedEx or UPS. It costs 9 euros in Europe and you will receive your order within 4 to 6 days after shipment (delivery times may be longer for the rest of the world and the cost may vary).
LEGAL GUARANTEES
Regardless of any commercial guarantee that may be granted, Paul Ward remains bound by the legal guarantee of conformity mentioned in Articles L. 217-4 to L. 217-14 of the Consumer Code and that relating to defects in the item sold, under the conditions provided for in Articles 1641 to 1648 and 2232 of the Civil Code.
When acting under the legal guarantee of conformity, the consumer:
- benefits from a period of two (2) years from delivery of the goods to act
- may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four (24) months following delivery of the goods.
The consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, he may choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.
Article L217-4 of the Consumer Code: The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
It is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been made its responsibility by the contract or has been carried out under its responsibility.
Article L217-5 of the Consumer Code: The goods comply with the contract:
1° If it is suitable for the use usually expected of a similar good and, where applicable:
– if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;
– if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article 1641 of the Civil Code: The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them.
Article 1641 (1st paragraph) of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect.
RIGHT OF WITHDRAWAL
In accordance with article L 221-18 et seq. of the Consumer Code, the Customer has a withdrawal period of fourteen days from the date of receipt of the order.
If the Customer exercises this right of withdrawal, the return of the product must be made no later than fourteen days following communication of his decision to withdraw, at his expense and in its original packaging and condition, i.e. without excessive handling (absence of significant deterioration of the packaging or the product, original, cleaned lenses, labels, product flyers and packaging of the glasses included) and accompanied by the delivery slip.

The Customer bears the risks of transport.
A product returned damaged or with missing parts cannot be returned.
Once the return has been validated by Paul Ward, the refund will be made within 14 days from the day on which we have received and checked all the products subject to withdrawal from this contract.
PERSONAL DATA
The personal information requested for account creation and order processing is required to process the order. The data collected may not be used for any other purpose without the Customer's prior consent.
The Customer may request the deletion or modification of their data. Simply send an email to the following address: hello@paul-ward.com.

Our idea is simple, and that's probably what makes it unique: to offer beautiful, well-made glasses, with a European production circuit as close as possible.
Designed in Paris, made in Italy and sold directly, only in our stores, they are therefore more accessible.
A real short circuit
Our commitments
The goal of creating a production and distribution model without intermediaries goes far beyond being able to offer a fair price for our glasses. It is, above all, an ecological and societal commitment.
You can't claim to be "sustainable" or "ethical" when you're flying glasses in from China. That's why we produce our glasses in Italy and our lenses less than 100 km from Paris.
We have chosen European materials and production as locally as possible.
Our glasses are now made from cellulose eco-acetate for so-called "plastic" frames; it's the most environmentally neutral material. It's produced from cotton flower polymerized using non-carbon solvents. In other words, it's petroleum-free. It's a biodegradable and recyclable material.
We believe there is still much progress to be made in terms of ecology and that every action counts. That's why we are proud of what we have accomplished, but we are also aware that there is still a long way to go before we are, one day, completely neutral.
Finally, by manufacturing 100% of our corrective lenses with Novacel, we are working to revitalize the French industrial sector at a time when none of our direct competitors produce their lenses in France or even in Europe. This is a societal act that we believe is essential. France possesses unique expertise in ophthalmic lenses. We will always campaign to preserve it.
